Terms of Use

1. Purpose and scope
These terms of use (hereinafter the "Terms") govern access to and use of the Onde Interactive platform, a trading name of Yves Léon EI.
Onde Interactive is an online surf video competition platform. It allows videographers and photographers to submit surf clips, and registered judges to rate them through a head-to-head voting system, two clips at a time.
Use of the platform implies unreserved acceptance of these Terms. Anyone accessing the platform is required to comply with them.
These Terms do not govern the financial conditions of the service. The paid services — activating a crew and publishing a competition — are covered by the terms of sale (hereinafter the "Terms of Sale"), which prevail over these Terms in all matters relating to prices, ordering, payment, the right of withdrawal and guarantees.
2. Legal information
In accordance with the provisions of law no. 2004-575 of 21 June 2004 on confidence in the digital economy (LCEN), the following information is brought to the attention of users:

The other providers involved in storing and processing content — database, video files, transcoding, payment, email — are listed with their locations in the privacy policy.
4. Access to the service and registration
4.1 Conditions of access
Access to Onde Interactive requires the creation of an account, reserved for persons aged at least 15 — the threshold set by article 45 of law no. 78-17 of 6 January 1978 as amended, the reason for which is set out in the privacy policy. The user declares their age on registration: this is a condition of eligibility, not consent within the meaning of the GDPR.
This condition concerns the account holder. It does not prevent a minor from appearing in a clip: that situation is governed by article 5.1 below.
4.2 Obligations on registration
The user undertakes to provide accurate, complete and up-to-date information when creating their account. They are solely responsible for keeping their login credentials confidential.
Onde Interactive reserves the right to refuse or terminate access to any account whose information is inaccurate or fraudulent.
5. Your content
5.1 Warranty given by the uploading user
By uploading content, you stand as its guarantor.
By submitting a video clip, a photograph or any other content to Onde Interactive, you declare and warrant that:
- Copyright — you are the author of the content, or you hold a written licence from the photographer or videographer authorising you to publish it on the platform;
- Image rights of adults — you have obtained the consent of each clearly identifiable person appearing in the content, including where filmed in a public place. The only persons escaping that requirement are those forming an incidental background of a collective scene and not individualised — which is never the case of the surfer, the main subject of the clip;
- Image rights of minors — if a clearly identifiable person is a minor, you have obtained the written authorisation of both holders of parental authority. Publishing a minor's image is not a routine act: the agreement of a single parent is not sufficient (article 372-1 of the French Civil Code — Code civil);
- Lawfulness — the content does not breach any applicable law and does not fall within any of the categories prohibited under article 5.3.
A parental authorisation template is made available to you. Onde Interactive neither collects nor retains it, and exercises no prior control over the authorisations obtained.
Warranty and indemnity. You shall indemnify Onde Interactive against any claim, action, defence costs or damages resulting from a breach of the foregoing declarations, including where the claim is brought by a third party whose image, work or data appears in the content you uploaded. The removal of content (article 6) does not prejudge your liability and does not release you from this warranty.
5.2 Licence granted to the platform
By submitting a clip, you grant Onde Interactive a non-exclusive, royalty-free licence limited to displaying the clip within the competitions and to the technical operations that such display entails (storage, transcoding, thumbnails). It ends when the content is deleted or when the competition is definitively closed. You retain full ownership of your content.
5.3 Prohibited content
The following content is strictly prohibited:
- content undermining human dignity, public order or public decency;
- defamatory, violent, pornographic, hateful or discriminatory content;
- content depicting minors in a degrading or sexualised manner;
- content infringing third-party intellectual property rights;
- content containing third parties' personal data without their consent;
- content published in breach of article 5.1.
Onde Interactive reserves the right to remove any content breaching these provisions, under the conditions of article 7 below.
6. Reporting and removal procedure
Any person whose image appears in a video published on Onde Interactive, or whose rights are harmed by content, may request its removal. An account is not required in order to report content.
6.1 How to submit a request
Use the contact page, reason “Removal request”, or send your request by email to contact@ondeinteractive.com, stating:
- your identity and contact details;
- precise identification of the content (URL or clip title);
- the nature of the harm alleged (image rights, copyright, etc.);
- the reasons why you consider the content unlawful.
You will receive an acknowledgement of receipt. The decision taken and its reasons will be communicated to you, as well as to the user who uploaded the content.
6.2 Processing times
Onde Interactive undertakes to handle requests relating to image rights within 72 hours of receiving a complete request. The content is suspended or removed while the request is examined.
For other types of request, the processing time is 7 working days.
6.3 Hosting provider liability regime
Onde Interactive provides a hosting service within the meaning of article 3, g), iii) of Regulation (EU) 2022/2065 of 19 October 2022 on a Single Market for Digital Services ("DSA").
In accordance with article 6 of the DSA, a hosting service provider is not liable for the information stored at the request of a user, provided that it does not have actual knowledge of the illegal activity or illegal content and that, from the moment it obtains such knowledge, it acts expeditiously to remove it or to disable access to it.
The LCEN, whose corresponding provisions were adapted by law no. 2024-449 of 21 May 2024 aiming to secure and regulate the digital space (known as "SREN"), now refers to that regime and organises its implementation under French domestic law, in particular the obligations of identification, retention and cooperation with the authorities.
Article 17 of the DSA, which is separate, governs the statement of reasons for moderation decisions: it is implemented in article 7 of these Terms.
7. Content moderation (art. 14 of the DSA)
7.1 What we moderate
Onde Interactive removes or restricts access to content in three cases, and only in those cases:
- the content is manifestly illegal;
- the content breaches article 5.3 of these Terms;
- a person concerned obtains removal on the basis of their image rights or their copyright, under the procedure of article 6.
The possible measures are: removal of the content, disqualification of a clip from a competition, suspension of the account, and termination of the account. The measure chosen is proportionate to the seriousness and the repeated nature of the breach.
7.2 How decisions are made
Every moderation decision is taken by a human being. Onde Interactive uses no automated decision-making system and no profiling to remove content, disqualify a clip or suspend an account. No automatic filter analyses videos before they are published.
Onde Interactive acts diligently, objectively and proportionately, taking into account the rights and interests involved, in particular freedom of expression and image rights.
7.3 Informing you and challenging a decision
The author of the content concerned receives a written statement of reasons for the decision: the content targeted, the measure taken, the ground — clause of the Terms or legal provision — and the route for challenging it.
To challenge a moderation decision, write to contact@ondeinteractive.com with the subject line "Challenge to a moderation decision". The request is re-examined by a natural person within 7 working days. If the re-examination concludes that an error was made, the content is restored.
You retain, in any event, the option of bringing the matter before the competent court and, if you are a consumer, of using mediation under the conditions provided for in the Terms of Sale.
7.4 In summary, in plain language
This summary is provided pursuant to article 14(3) of the DSA. It has no contractual value: only the articles above do.
- You can post your surf videos, but only if you have the right to.
- If someone can be recognised in your video, you must have asked them first.
- If that person is under 18, you need written permission from both of their parents.
- Videos that are violent, sexual, hateful, or that aren't yours are not allowed.
- If someone reports your video, a person — not a robot — watches it and decides. If it gets taken down, we tell you why.
- If you don't agree, you can write to us at contact@ondeinteractive.com and we'll look at it again.
- If you appear in a video and you don't want to, write to us: we take it down within 72 hours.
- To create an account, you have to be at least 15.

Languages accepted: French and English.
Onde Interactive does not rely exclusively on automated tools to communicate with users and authorities. Messages sent to these points of contact are read and handled by a natural person. No conversational robot is interposed.
9. Community competitions
9.1 The crew organises. Each competition is created and organised by the crew that publishes it. The crew is its organiser and bears responsibility for it, including as regards the rights attached to the clips it contains. By way of exception, competitions published by Onde Interactive itself are organised by Onde Interactive.
9.2 Onde Interactive supplies the tool. Onde Interactive acts as a technical service provider: it hosts the content and runs the voting mechanism. It does not organise crews' competitions, does not select their participants and does not intervene in their results.
9.3 Taking part is free. Participation is free of charge and involves no obligation to purchase, both as a judge and as a rider or videographer. It requires an account (article 4) and compliance with the eligibility conditions announced on the competition page. The paid services concern organisers only and are described in the Terms of Sale.
9.4 The vote. Clips are assessed by the registered judges, who compare them two at a time. Each judge votes independently of the others. The ranking aggregates all those votes and expresses the preference of the community — and nothing else: no competition confers any prize, no sum of money, no award in kind, no advantage of monetary value. An organiser may not attach to the results a prize or an advantage obtained outside the platform.
9.5 Manipulating a ranking is prohibited. Prohibited in particular are the creation of multiple accounts, the buying of votes and any organised coordination aimed at distorting a result.
9.6 Disqualification. A clip may be disqualified if it was published without the rights required by article 5.1, if it falls under the content prohibited by article 5.3, if it does not meet the competition's eligibility conditions, or if its votes have been manipulated. The decision is taken by a natural person and accompanied by written reasons; it may be challenged under the conditions of article 7.3.
10. Organisations' posts — advertising labelling
Where a crew communicates about its competitions through its own channels, it is for that crew to disclose the commercial nature of the post where it constitutes advertising or paid promotion, pursuant to law no. 2023-451 of 9 June 2023 regulating commercial influence and articles L. 121-1 et seq. of the French Consumer Code (Code de la consommation).
Onde Interactive exercises no control over those posts outside the platform and is not answerable for them.
11. Accounts and termination
At your initiative. You may delete your account at any time from your settings or by writing to contact@ondeinteractive.com. Your personal data, clips and votes are then deleted in accordance with the privacy policy. Deletion has no effect on sums already paid for services performed; the refund conditions are set out in the Terms of Sale.
At Onde Interactive's initiative. An account may be suspended or terminated in the event of non-compliance with these Terms or of fraudulent conduct, under the conditions of article 7 — human decision, written statement of reasons, route for re-examination.
12. Liability and limitations
Availability. The service is provided as is. Onde Interactive does not guarantee its continuous or uninterrupted availability: maintenance interruptions or technical failures may occur.
Indirect damage. Onde Interactive is not liable for indirect damage, operating losses, loss of profit or commercial harm resulting from the use of or the inability to use the service.
None of these limitations obstructs the statutory guarantees owed to consumers, recalled in the Terms of Sale, nor is enforceable against them to the extent that the law prohibits it. Liability for content submitted by users is governed by articles 5.1 and 6.3.
13. Intellectual property — Platform
All the components of the Onde Interactive platform — name, logo, interface, design, features — are the exclusive property of Yves Léon EI and are protected by intellectual property law.
Any unauthorised reproduction, representation, modification or exploitation of these elements is prohibited.
Content submitted by users remains their property; the licence granted to the platform is limited as described in article 5.2.
14. Personal data
The processing of personal data is described in the privacy policy and the cookie policy.
15. Amendments to the Terms
Onde Interactive may amend these Terms. Any substantial amendment is brought to users' attention by any appropriate means. The version date at the top of the document is systematically updated and the version history is retained.
16. Applicable law and competent jurisdiction
These Terms are governed by French law.
In the event of a dispute relating to their interpretation or performance, and failing amicable resolution within 30 days, the parties shall submit to the jurisdiction of the French courts.
If you are a consumer, you retain the option of bringing proceedings before the courts of your place of residence and of using a consumer mediator free of charge, under the conditions set out in the Terms of Sale.
